About Us

We intend to accomplish these goals by implementation of the following six components:

1) PREVENTION:

Prevention activities allow us to get out in the public and talk about the harmful effect that alcohol and drugs have on your body. We participate in activities such as the annual county fair, health fairs, safety days and earth day.

2) ENFORCEMENT:

The Enforcement component provides local law enforcement agencies with funding of overtime for saturation patrols, road blocks, shoulder taps and under age drinking patrols.

3) COMPLIANCE MONITORING AND TRACKING (CMT):

This component utilizes personnel in the courts who upon adjudication of a case, conduct an intake with the client. At this intake, the case is reviewed in its entirety to insure the client understands all court ordered sanctions. Referrals are made to following agencies as required: DWI School, Alcohol Screen, Community Service, Ignition Interlock, Treatment, Jail Commitment and Probation Supervision.

Compliance Tracking: This portion of the CMT utilizes the state mandated ADE NEEDS Survey to track the client on all court ordered sanctions. This program allows the trackers to open a data base program and open compliance screens, set compliance dates and have the ability to check on anyone who is non compliant and take necessary action.

4) ALCOHOL SCREENING:

Alcohol Screening is administered by a LISW. This component allows DWI Offenders to be screened and treatment recommendations provided to the courts, if the client needs treatment; we provide listings of local facilities.

5) ALTERNATIVE SENTENCING:

This component can be implemented in more than one way; one is the Electronic Monitoring Program and the other is TEEN COURT. These programs allow an alternative to jail. The EM program allows Convicted DWI Offenders to be released and monitored at work and home. Minors with minor offenses are allowed to plead guilty and are referred to Teen Court via Juvenile Probation and Parole, be sentenced by a jury of their peers, complete their sentence and have their record cleared. This is only for teens with minor traffic and misdemeanor offenses and can only be utilized once.

6) COORDINATION, PLANNING AND EVALUATION:

This component is the responsibility of the Program Director, Paige Viscarra, who is responsible for the day to day operations of the DWI Offender Supervision Program by overseeing budget preparation and administration, program reporting requirements, staff supervision and general planning and administration of office and program functions. The program director oversees all funded components to ensure success and efficiency.

Local DWI Grant Program - Statutory Authority

The 1993 New Mexico Legislature enacted Laws of 1993, Chapter 65. A portion of the law created the Local DWI Grant Program Act, compiled as Sections 11-6A-1 through 11-6A-6, NMSA 1978, as amended.

Program Oversight

The legislation, 11-6A-4 NMSA 1978 as amended, gives oversight of the Program to the DWI Grant Council. "Council" means the New Mexico DWI Grant Council, which was created under the Local DWI Grant Program Act. Membership of the Council consists of the president of the New Mexico Municipal League or a designee, the president of the New Mexico Association of Counties or a designee, the secretary of the Department of Health or the Secretary's designee, the secretary of the Department of Finance and Administration or the Secretary's designee, chief of the Traffic Safety Bureau of the State Highway and Transportation Department, and two representatives of local governing bodies, appointed by the Governor. The Local DWI Grants are awarded by the DWI Grant Council upon their review and approval of the grant programs and plans contained in the county's annual grant application.

Local Driving While Intoxicated Program (DWI)

The Local DWI Programs in New Mexico are administered by the Department of Finance, Local Government Division (LGD) and are responsible for the statewide programs. Otero County has three funding sources used in support of the local program:

1. A distribution based on 41.5 percent of gross receipts sales tax from Otero County and the number of alcohol-related injury crashes.

2. Grants awarded to counties on a competitive basis.

3. Fees collected for screening and fees paid by convicted DWI offenders.
